1. Acceptance of Terms

By creating an account or using Kinan's services, you agree to these Terms of Service and our Privacy Policy. If you are using Kinan on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Service

Kinan provides a security awareness training and phishing simulation platform ('Service') that includes:

• Security awareness training courses and content
• Phishing simulation campaigns
• Risk analytics and reporting
• User management and integrations
• Learning management features

3. Account Registration

To use our Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be at least 18 years old or have parental consent

You are responsible for all activities that occur under your account.

4. Subscription and Payment

4.1 Subscription Plans

Access to Kinan requires a paid subscription. Pricing is based on the number of users and selected features. Current pricing is available on our website or from our sales team.

4.2 Payment Terms

• Subscriptions are billed in advance (monthly or annually)
• Prices are exclusive of taxes unless stated otherwise
• Failed payments may result in service suspension
• Refunds are provided in accordance with our refund policy

4.3 Free Trial

We may offer a free trial period. At the end of the trial, you must subscribe to continue using the Service. Trial accounts that are not converted may be deleted.

5. Acceptable Use

You agree NOT to:

• Use the Service to send phishing simulations to individuals outside your organization without consent
• Use the Service for actual malicious phishing or fraud
• Reverse engineer, decompile, or attempt to extract source code
• Share account credentials or allow unauthorized access
• Upload malicious code or attempt to compromise the Service
• Use the Service in violation of any applicable laws
• Resell or redistribute the Service without authorization

6. Intellectual Property

6.1 Our Content

Kinan and its licensors own all rights to the Service, including training content, templates, software, and documentation. You receive a limited, non-exclusive license to use these materials for your internal security awareness purposes.

6.2 Your Data

You retain ownership of data you upload to the Service. You grant Kinan a license to use this data to provide and improve the Service. We may use anonymized, aggregated data for research and product improvement.

7. Phishing Simulation Terms

When conducting phishing simulations:

• You must only target employees of your organization who have been informed that simulations may occur
• You are responsible for compliance with local laws regarding employee monitoring
• Simulations must be used for security awareness purposes only
• You must not use simulation data for disciplinary action without appropriate policies in place

8. Service Level

We strive to maintain high availability. For Enterprise customers, specific SLA terms are detailed in your contract. We are not liable for interruptions due to factors beyond our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Kinan's total liability shall not exceed the fees paid in the 12 months preceding the claim
• We are not liable for indirect, incidental, or consequential damages
• We do not guarantee that the Service will prevent all security incidents

10. Indemnification

You agree to indemnify and hold Kinan harmless from claims arising from your use of the Service, violation of these terms, or violation of any rights of third parties.

11. Termination

• You may cancel your subscription at any time through your account settings
• We may suspend or terminate accounts that violate these terms
• Upon termination, you may request export of your data within 30 days
• Sections regarding IP, liability, and indemnification survive termination

12. Changes to Terms

We may modify these terms with 30 days notice for material changes. Continued use after changes take effect constitutes acceptance. If you disagree with changes, you may terminate your subscription.

13. Governing Law

These terms are governed by the laws of the United Arab Emirates. Disputes shall be resolved in the courts of Dubai, UAE, unless otherwise agreed in your contract.
